Making sure you can make a valid will
To make a valid will, the law of England and Wales expects that, at the time you make it, you:
- understand that you are making a will and what a will does;
- have a general idea of what you own;
- are aware of the people who might reasonably expect to benefit (such as close family), even if you decide not to include them; and
- are not affected by any condition of the mind that distorts your decisions about who should benefit.
If you have any doubt about any of these — for example because of illness or a recent diagnosis — please speak to a solicitor, and consider asking your doctor to confirm you are able to make a will. This is especially wise for anyone who is elderly or unwell.

How we handle your information
Please read this before you start.
This will-preparation tool is provided by Fit to Retire Ltd (company number 14464898). Fit to Retire Ltd is the data controller for the information you enter here.
We collect only what is needed to prepare your will document: your name, address and date of birth, and the names and addresses of the people and charities you choose as executors, guardians and beneficiaries. We also collect your answers to the short eligibility questions so we can check this simple tool is right for you, and your email address so we can send your payment receipt. We do not ask for third parties' phone numbers or health details, and we ask you not to enter sensitive information you have not been asked for.
If you tick the optional marketing box, we add your name and email address (only) to Fit to Retire Ltd's mailing list so we can send you helpful information about retirement and financial planning. We never share the contents of your will, or any details of your executors, guardians or beneficiaries, for marketing. You can unsubscribe at any time, and if you don't tick the box we won't use your details for marketing at all.
We process your information to provide the service you have asked and paid for (this is the 'contract' lawful basis under UK GDPR). Some information you give about family relationships is included only because it is needed to identify people in your will.
Your will names other people (executors, guardians, beneficiaries). We process their details on the basis of preparing your will, at your request. Please only include people whose details you are entitled to share for this purpose.
We automatically delete your answers and your generated will document 30 days after you create it, unless you ask us to keep a copy for longer. Keep your own downloaded copy safe — after 30 days we cannot recover it for you.
Your information is encrypted while it travels to us and while we store it. We do not record your answers or your will in our ordinary system logs.
Under UK GDPR you can ask us for a copy of your information, ask us to correct or delete it, or object to how we use it. Contact Fit to Retire Ltd to do this. You can also complain to the Information Commissioner's Office (ICO) at ico.org.uk.
